These terms of booking and payment apply to all programme services offered and delivered to individual customers by Loihakka Oy on its Loihakka.fi webshop.
The Loihakka.fi webshop, managed by Loihakka Oy, offers programme services.
Confirmation of booking:
Services will be charged in full at time of booking. A reservation is considered confirmed once the payment has been made. If no payment is made, we reserve the right to cancel the reservation
Cancellation of your booking (fully or partly):
More than 28 days prior to the first day of your booking – an advance payment of 10% will be charged.
27 to 14 days prior to the first day of your booking – a cancellation fee of 50% will be charged.
13 to 0 days prior to the first day of your booking – full price of the service will be charged.
Changes to your booking:
Any changes and cancellations must be made in writing and dated (email). If you change your booking less than 28 days prior to its’ first day, a service fee of €10 per change will be charged.
Reduced fees:
Possible reduced fees for children or students are stated separately in each programme description.
Force majeure:
All program services are subject to weather. Neither party can be held liable for financial or other losses, damage or cost caused by a Force Majeure situation. Force majeure situations are, including but not limited to, war, strike, weather conditions, lack of snow or ice, or other natural conditions. Loihakka Oy does not compensate the client for other travel expenses, including but not limited to flights, services purchased elsewhere arising from the force majeure situation.
Applicable law and jurisdiction:
These terms are construed and interpreted in accordance with the laws of Finland. Disputes, disagreements or claims related to these terms or to the activities of Loihakka Oy shall be settled exclusively by Finnish courts. The District Court of Oulu is the primary place of settlement. If any of these terms are considered either wholly or partially invalid or illegal, or there are problems with their implementation, the remaining terms will remain valid.
Loihakka Oy reserves the right to change services or prices. Services may be changed due to weather conditions or safety. Prices may be adjusted due to increase in supplier prices beyond Loihakka Oy’s control (including but not limited to changes in taxation or fuel prices).
Safety and insurances:
Loihakka Oy have a proactive approach to safety in all their operations, and they comply with all relevant and appropriate safety plans as well as health and safety standards in compliance with the Finnish laws and regulations.
Programme services:
Boats and snowmobiles used in programme services are insured in accordance with the laws of Finland. The statutory insurance will compensate for personal and property damage caused by the use of the vehicle in traffic, in accordance with the Finnish Insurance Act. The scope of compensation includes all personal injuries and damage to the property of the counterparty in accordance with Finnish laws and regulations, taking the regulations by authorities into account. Damage to one’s own vehicle and property in the car is excluded from the insurance coverage. Damage to the personal effects of passengers in the vehicle, however, is compensable.
Service providers reserve the right to change the content of their services if necessary. Programme services are only implemented weather and snow conditions permitting. Bad weather conditions, very cold weather, lack of snow, or thin ice at crossing points may result into changes in the programme or cancellation. The service provider also has the right to interrupt the program service if a customer’s actions are causing a safety risk to themselves or others, or their health does not allow for the service to be continued.
Other injuries and damages:
Service provider shall only be liable for personal injury or damage to property caused by accidents occurring during the service and resulting from the defective equipment or misconduct of the service provider, its employees or subcontractors. The service provider is not liable for any damage or injuries that may be compensated under the client’s own travel insurance. We recommend taking personal travel and accident insurance for all customers.
Programme services and activities can be physically demanding, and participants may be exposed to vibration. If you have any health restrictions (including, but not limited to heart disease, back pain, or similar, or if you are pregnant), you must check with your doctor before taking part to see if your health is limiting your participation. The client is responsible for ensuring that the service provider receives information about any limitations or risk factors prior to the service.
